NEWARK, NJ - Commercial driver's license (CDL) holders charged with driving under the influence in New Jersey face severe consequences even when arrested in their personal vehicle, including a one-year CDL disqualification on a first offense. New Jersey DUI attorney Rachel Kugel of The Kugel Law Firm (https://thekugellawfirm.com/how-long-do-you-have-to-wait-to-get-a-cdl-after-a-dui/) explains how a personal vehicle DUI conviction can threaten a commercial driving career and what defense options may be available.

According to New Jersey DUI attorney Rachel Kugel, federal law treats a DUI conviction as a major offense for CDL holders regardless of which vehicle was being operated at the time of the arrest. Under 49 CFR 383.51, a first DUI conviction triggers a one-year CDL disqualification, while a second conviction results in a lifetime disqualification. "Many commercial drivers are surprised to learn that an off-duty arrest in a personal car can cost them their commercial license for a year or more," Kugel explains.
New Jersey DUI attorney Rachel Kugel notes that the consequences extend well beyond the criminal courtroom. CDL holders face standard New Jersey DUI penalties under N.J.S.A. 39:4-50, including fines, possible jail time, and ignition interlock device requirements, plus the additional CDL-specific disqualification under N.J.S.A. 39:3-10.20. The blood alcohol concentration threshold is 0.04 percent when operating a commercial motor vehicle and 0.08 percent in a personal vehicle.
Kugel points out that New Jersey applies graduated penalties based on the BAC reading. A first offense with a BAC between 0.08 and 0.099 percent generally carries a $250 to $400 fine, license forfeiture until an ignition interlock device is installed, and a three-month interlock requirement. Higher BAC tiers increase both the fine range and the interlock period, and a reading of 0.15 percent or higher triggers a mandatory three-month license forfeiture along with extended interlock obligations after restoration.
The Kugel Law Firm represents drivers in municipal courts throughout Hudson County, including Jersey City Municipal Court at the Lewis S. McRae Justice Complex on 365 Summit Avenue, Newark Municipal Court, and Hoboken Municipal Court. Jersey City is home to major logistics and transportation operations along the waterfront and near the Holland Tunnel, and commercial drivers in this corridor depend on a clean driving record to maintain employment with regional carriers.
"The FMCSA Drug and Alcohol Clearinghouse adds another layer of consequence for commercial drivers," Kugel notes. As of November 2024 under the Clearinghouse II rule, a "prohibited" status results in the automatic removal of commercial driving privileges from the license. Reinstatement requires completing the return-to-duty process, which includes evaluation by a DOT-qualified Substance Abuse Professional, treatment, a negative return-to-duty test, and follow-up testing for one to five years.
Attorney Kugel observes that several defense strategies may apply to a CDL holder's DUI case. These include challenging whether the initial traffic stop was supported by probable cause, questioning the calibration and administration of the Alcotest device used for breath testing in New Jersey, identifying medical or dietary conditions that can affect breathalyzer results, and reviewing whether officers followed required procedures during the arrest. Each defense depends on the specific facts of the case.
For drivers seeking to return to commercial driving after a disqualification period ends, the New Jersey Motor Vehicle Commission requires completion of any court-ordered DUI education, payment of reinstatement fees, and in many cases retesting on the written and skills examinations. Drivers with a Clearinghouse violation must also have their status updated to "not prohibited" before commercial driving privileges can be restored.
"Acting quickly after a DUI arrest gives the defense the most options," Kugel adds. "Evidence can be preserved, discovery can be requested promptly, and procedural challenges can be developed before the case moves through municipal court."
For CDL holders in Hudson County or elsewhere in New Jersey facing DUI charges in a personal vehicle, contacting an experienced DUI defense attorney early in the process may help protect both the standard driver's license and the commercial driving credentials that support their livelihood.
